Ранее на yes-vinnytsia.com.ua мы рассказывали, как Федор* из Оратова пытался реализовать свое законное право на альтернативную гражданскую службу. Что же было дальше? Как ответили на его просьбу различные инстанции? Что произошло после неявки по “боевой” повестке?

Попытки найти невоенную службу

Из Винницкого РТЦК и СП чуть позже пришел ответ, подписанный его начальником, Александром Бойко. В нем отмечалось, что во время военного положения не установлен порядок и механизм замены военной службы на альтернативную (невоенную). В конце говорилось:

“При случае сообщаю Вам об обязанности прохождения медицинской комиссии как военнообязанного, для определения пригодности к прохождению военной службы”.

Но Федор подал также заявление в местный орган власти, Оратовский поселковый совет. И через некоторое время получил ответ о том, что оно “не может быть решено поселковым советом”, а значит, по этому вопросу рекомендуется обратиться в Винницкую районную государственную администрацию. В конце стояла подпись исполняющей обязанности председателя ОТГ, Леси Ларионовой.

Что ж, верующий послушно продолжил проходить этот квест и отправил соответствующее заказное письмо, которое дублировал на емейл Винницкой районной военной администрации. Рассмотрение заявления заняло еще некоторое время, но не более 30 дней. Письмо, подписанное заместителем начальника районной военной администрации Владимиром Цвигуном, рекомендовало обратиться… в Оратовскую территориальную громаду.

Круг замкнулся. Было похоже, что на решение проблемы никто из местных властей полномочий не имеет. Но в промежутке между рассмотрением заявлений в трех инстанциях были и другие, более драматичные события.

Боевая повестка, неявка, последствия

Федор проходил ВВК еще 2022 году, причем дважды в разных городах, и признан годным. Впервые сделал это, когда гостил у друга в Ивано-Франковской области, а второй раз – уже дома, в Оратове. Тогда все обошлось предоставлением справки о принадлежности к религиозной общине. Верующий понимал, что с тех пор его состояние здоровья резко не ухудшилось, о чем и сообщил ТЦК, где документы о пройденной медицинской комиссии хранились. Однако офицер Иван Березняк настаивал на необходимости пройти ВВК повторно, потому что планировались некоторые изменения в законодательстве.

Прохождение медицинского осмотра заняло аж 4 дня, что частично можно объяснить очень ответственным отношением врачей, а иногда – их отсутствием на месте. Как-то ему пришлось ждать более часа, чтобы просто поставить подпись. На четвертый день Федор должен был ехать в соседние Ильинцы для сдачи теста на ВИЧ и заплатить за него около 400 гривен из собственного кошелька!

По возвращении из Ильинцов пришлось еще некоторое время потратить на подготовку заключения председателем врачебной комиссии, ответить на вопросы психологического теста и подписать “боевую” повестку на поездку в учебный центр, датированную следующим днем. Отказываться от подписания наш герой не стал, но уже тогда склонялся к решению не приходить по повестке, понимая: согласие ехать в учебный центр – это согласие на военную службу, поэтому следующий визит в ТЦК проигнорировал.

Военные

На следующий день произошло то, что и должно было произойти в такой ситуации. К дому верующего приехала группа военных – примерно 6-7 мужчин в форме, которые попросили объяснений. Федор сказал, что своей неявкой проявил несогласие с предложенным вариантом службы. Ему было предложено проехать вместе в ТЦК для объяснений, но он отказался. 

– Тогда мы вызываем полицию по этому адресу, – сказал один из военных.

– Не имею возражений, – ответил Федор, зашел в дом и закрыл за собой дверь.

Полиция

На следующее утро героя истории разбудил стук в окошко. Это были двое представителей полиции. Показав удостоверения, они попросили прокомментировать ситуацию с неявкой по повестке. Федор объяснил, что ехать в учебный центр ему не позволяют религиозные убеждения. Представители правоохранительных органов поинтересовались, есть ли какой-то прецедент, когда такая служба предоставлялась во время войны. Верующий объяснил, что такие случаи он слышал и варианты могут быть: обустройство бомбоубежищ, выдача гуманитарки, ликвидация последствий ракетных обстрелов.

– На мой взгляд, даже во время войны Украина продолжает оставаться правовым государством, – сказал Федор заготовленную заранее фразу.

Полицейский, который вел разговор, согласился, но напомнил также об обязанностях, которые имеют граждане. Собственно, верующий и не уклонялся от них. А просто не мог реализовать свое право на гражданскую службу из-за отсутствия соответствующего механизма.

В конце концов полиция предложила проехать в ТЦК для разрешения ситуации. На этот раз Федор согласился, так как увидел, что правоохранители искренне хотят помочь и не считают его злостным уклонистом. Однако сам чувствовал себя так, как Кевин из фильма “Один дома”, который не оплатил покупки в супермаркете и сбежал, сказав: “Я преступник”.

В ТЦК пришлось провести еще некоторое время, выслушав упреки работника по имени Денис, трактовавшего неявку как обман. Также именно в этот день Федору зачитали и предоставили официальный письменный отказ в альтернативной службе от Александра Бойко из Винницкого РТЦК и СП, частично процитированный выше.

Уголовное дело открывать не стали, но выписали новую повестку. На этот раз – для уточнения данных.
